Service Agreement
1. General
This Service Agreement ("Agreement") is entered into between Linux Hosting ("Company", "we") and the client ("Client", "you") and governs the terms of use for hosting, VPS, dedicated server, and Linux infrastructure services provided by the Company. The Agreement takes effect upon placing an order or registering for a service.
2. Scope of Services
The Company provides shared web hosting, VPS servers (managed and unmanaged), reseller hosting, and Linux IT and infrastructure services. Service details, allocated resources, and pricing are specified on the relevant order page and in the client invoice.
3. Service Level Agreement (SLA)
The Company guarantees 99.9% annual server uptime, excluding scheduled maintenance. Scheduled maintenance will be coordinated in advance and performed during low-traffic hours whenever possible. In case of failure to meet the uptime target, the Client is entitled to a proportional credit based on the downtime period.
4. Client Responsibilities
- The Client is responsible for independently backing up their content, in addition to backups performed by the Company.
- The Client is responsible for securing their management account, including passwords and access credentials.
- The Client agrees not to use the services for any illegal activity or in violation of the Terms of Use.
- The Client is responsible for keeping their contact and billing information up to date.
5. Billing and Payments
Payment is made in advance according to the selected billing cycle (monthly, quarterly, annual, or biennial). Invoices are issued automatically and sent by email. Non-payment within 7 days of the billing date may result in service suspension. After 30 days of non-payment, the Company may delete the account and all associated content.
6. Cancellation and Refunds
The Client may cancel the service at any time by contacting support or through the client area. A full refund is available within 14 days of the initial order, in accordance with Israeli Consumer Protection Law. After this period, cancellation takes effect at the end of the current billing cycle without a refund.
7. Data Handling
The Company is committed to maintaining the confidentiality of client data and will not disclose information to third parties unless required by law. Upon service termination, the Client may request a data transfer within 30 days. After that, data will be deleted from the servers.
8. Limitation of Liability
The Company shall not be liable for indirect, consequential, or special damages arising from use or inability to use the services. The Company's liability is limited to the amount paid by the Client in the preceding three months.
9. Governing Law and Jurisdiction
This Agreement is governed by the laws of the State of Israel. Exclusive jurisdiction is granted to the competent courts in the Southern District of Israel.
